Where an offender commits reckless conduct endangering life in the context of a home invasion, the mitigating circumstances of fear and self-defence operate powerfully to ameliorate objective criminality but do not extinguish it, particularly where the danger has passed by the time of the offending conduct. A combination sentence of imprisonment with a community corrections order may fall outside the available range for serious firearms offending even where there are powerful mitigating circumstances including cooperation with authorities, guilty plea, and rehabilitation. The offence of possessing a firearm as a prohibited person is assessed independently of subsequent events and its gravity is unaffected by the circumstances in which the firearm comes to be used.
