The preferred approach to assessing the gravity of negligent driving offences is to consider where the case falls on the spectrum of offending using comparable cases as 'yardsticks', rather than categorising offences into 'upper', 'mid' or 'lower' range. Where a single act of negligent driving injures multiple victims, cumulation is required to avoid rendering any victim a 'meaningless statistic', subject to the totality principle. The merciful attitude of child victims towards an offender parent cannot be given much weight in sentencing.
