A new psychiatric diagnostic label applied to an offender's condition does not constitute fresh evidence on a sentence appeal where the substance of the diagnosis and its impact on the offender were already before the sentencing judge. Post-sentence improvement in an offender's mental condition does not shed fresh light on facts at the time of offending and is relevant to executive parole decisions, not to sentence appeals.
