An applicant seeking an extension of time to appeal against conviction must provide a satisfactory explanation for the delay and demonstrate that the proposed grounds of appeal have merit. Where both the explanation for delay is poor and the proposed grounds lack substance, the application will be refused. Medical unfitness to instruct must be supported by evidence inconsistent with the applicant's demonstrated capacity to participate in other proceedings during the relevant period.
