'Possession' in s 73(1) of the Criminal Property Confiscation Act 2000 (WA) is not limited to physical possession but extends to legal and equitable rights and interests in property, consistent with the broad statutory definition of 'property'. Police may therefore exercise the power to stop, detain and compulsorily interrogate a person under s 73 even where the relevant property has already been seized and is in police custody, provided the person retains a right or interest in that property. The principle of legality does not require a narrower construction where the legislation has among its objects the abrogation of the right invoked.
