A conditionally suspended sentence for possession of MDMA with intent to sell or supply may be upheld where the combined effect of unusual circumstances of offending (opportunistic acquisition, ill-crystallised commerciality, ADHD-impaired judgment) and the offender's personal circumstances (unusually high rehabilitation prospects, counterproductive effect of imprisonment) make the case exceptional. An offender who pleads not guilty and continues to deny the intent element after conviction cannot be found to be 'deeply remorseful', though rehabilitative steps remain mitigating regardless of motivation. The distinction between remorse and rehabilitation must not be conflated.
