A video record of interview of an accused that contains no admissions against interest is inadmissible and the prosecution's failure to adduce it does not occasion a miscarriage of justice. Defence counsel's advice not to give evidence (as distinct from incorrect advice that the accused is not entitled to give evidence) is a forensic decision that does not give rise to a miscarriage of justice. The fact that an offender is of good character carries only limited weight in sentencing for child sexual offences because such offences often go undetected.
