Where a worker suffers two successive compensable injuries both materially contributing to total incapacity, the worker may access a new prescribed amount for the second injury after the prescribed amount for the first injury is exhausted, provided the first injury alone would not have continued to render the worker totally incapacitated. The Dawkins principle only precludes a claim for the second injury where the worker was already totally incapacitated solely by the first injury and the second injury added nothing to the existing incapacity. The question of how weekly payments should be apportioned between two concurrent compensable injuries for the purposes of the prescribed amount under cl 7(3) of sch 1 was left open.
