A decision-maker exercising the discretion under s 501CA(4) of the Migration Act may defer consideration of non-refoulement obligations to a future protection visa application where it is highly likely those obligations will be assessed in that process, but if the decision-maker elects to engage with such claims, active intellectual consideration must be given to them while maintaining appreciation that they are but one factor in the balancing exercise.
