A claim that a trustee in bankruptcy is a constructive trustee for trust beneficiaries will fail where legal title to the trust property never vested in the trustee in bankruptcy, and the trustee's only interest (the bankrupt's right of indemnification) cannot itself be the subject of a constructive trust for the trust beneficiaries.
