An abuse of process finding must be based on conduct in the proceedings actually stayed, not merely on a party's conduct in other proceedings, and a court should not reach an implicit conclusion that proceedings lack an arguable foundation at a hearing that is not a final hearing, strike-out application, or summary judgment application.
