Letters sent by an industry body to government Ministers responsible for safety regulation, raising genuinely held safety concerns about a competitor's product, are unlikely to constitute misleading or deceptive conduct under s 18 ACL where the Ministers would be expected to seek expert advice before acting, and may not constitute conduct 'in trade or commerce' where the letters are directed to safety regulators rather than purchasing entities.
