Muldrock error is not established merely by structural imperfections in sentencing remarks; the question is whether the sentencing judge gave primary or determinative significance to the standard non-parole period. Even where Muldrock error is found, the appeal will be dismissed if no lesser sentence is warranted upon re-exercise of the sentencing discretion. Comparable sentences do not fix boundaries that bind the court.
