The definition of 'waste' in the POEO Act Dictionary is inclusive and its paragraphs are not mutually exclusive; material that is processed, recycled, re-used or recovered can fall within multiple paragraphs. Temporary stockpiling of material on land constitutes both 'depositing on the land' (waste disposal by application to land under cl 39(1)) and 'waste storage' under cl 42 of Sch 1. The definition of 'asbestos waste' as 'any waste that contains asbestos' does not depend on the absolute or proportionate amount of asbestos. Under s 144(2), the defendant bears the onus of proving lawful authority, including proving that regulatory exemptions apply. Resource recovery exemptions operate to exempt activities, not waste — the waste remains waste regardless of whether the exemption applies.
