Differential verdicts on multiple counts involving the same complainant are not inconsistent where the evidence supporting the count resulting in conviction is substantially stronger than for the count resulting in acquittal — particularly where there is immediate complaint and independent corroboration for one count but not the other. A Markuleski direction is not undermined by a trial judge's reference to the obverse proposition that confidence in the complainant's evidence on one count may support confidence on the other, provided the judge reminds the jury of the prosecution's onus and the entitlement to return different verdicts. Button J left open whether a Markuleski direction may only refer to one line of reasoning and must not refer to its obverse.
