When assessing the objective seriousness of an offence under s 112(2) of the Crimes Act 1900 (NSW), the maximum penalty of 20 years must be understood as covering the most serious cases involving multiple offenders, offensive weapons and deprivation of liberty. An aggravated break and enter involving a single offender who punches the victim several times causing minor injuries, with the aggravation being intentional infliction of actual bodily harm, sits at the lower end of mid-range seriousness. A starting point sentence of approximately 6 years (before discount) is appropriate for such an offence, taking into account Form 1 matters of moderate seriousness.
