The element in s 307.11(1)(b)(ii) (as it stood before repeal) requiring belief that another person intended to use a border controlled precursor to manufacture a controlled drug may be proved by inference from the totality of the evidence, including the organised nature of the criminal operation, the value of the precursor, and the limited realistic scenarios for its use; direct evidence such as intercepted conversations is not essential. However, the majority and dissent disagreed on whether the evidence in this case was sufficient, with the dissent holding that a reasonable possibility existed that no purchaser had yet been identified at the time of importation. The element in s 307.11(1)(b)(ii) has since been repealed.
