Where aggravated sexual intercourse without consent with a child results in pregnancy, the pregnancy is a defining circumstance of the gravity of the offending that must be adequately reflected in sentence. A sentence of 7 years (NPP 4 years) for such an offence against an 11-year-old by a 47-year-old in a position of familial trust, measured against a 20-year maximum and 10-year SNPP, was manifestly inadequate and was increased to 9 years (NPP 5 years 3 months).
