Where a sentencing judge makes findings largely favourable to an offender regarding both objective seriousness and subjective circumstances, a sentence that does not reflect those findings will be manifestly excessive. An offender barely 18 years of age with unchallenged expert evidence of developmental immaturity contributing to the offending will have reduced criminality, and an offender suffering from serious mental illness at the time of offending is an inappropriate vehicle for general deterrence.
