Where an offender has established psychiatric and psychological conditions (such as PTSD, borderline personality disorder, and major depressive disorder), a sentencing judge must assess the effect of those conditions on the offender's moral culpability, even where the offence is assessed as being in the high range of objective seriousness and even where the conditions did not directly cause the offending. The reduction in moral culpability also mitigates the weight to be given to general deterrence. A background of domestic violence in the relationship is relevant to the offender's mental condition and moral culpability even where the specific offence did not arise from a domestic violence episode.
