The NSW Court of Criminal Appeal has power under s 73A of the Jury Act 1977 and/or its inherent jurisdiction in the administration of criminal justice to request the Sheriff to investigate potential jury irregularities, even where the trial court has declined to do so. A juror's social media post expressing prejudicial views before the verdict, combined with connections between jurors and parties or witnesses, is sufficient to raise a reasonable apprehension of partiality warranting investigation.
