Under s 93(1) of the Evidence Act 1977 (Qld), the 'person who supplied the information recorded in the statement' is the person who was the original source of the information, not the person who merely recorded information conveyed by another; accordingly, the availability or recollection conditions in s 93(1)(b) must be satisfied in relation to the source, not the recorder. The proviso in s 668E(1A) of the Criminal Code will not be applied where the wrongly admitted evidence may have affected the jury's assessment of a key witness's credibility on counts where the remaining evidence was not overwhelming.
