Under the Building and Construction Industry Payments Act 2004 (Qld), a claimant must serve a copy of an adjudication application on the respondent 'as soon as possible' after lodgement, by operation of s 38(4) of the Acts Interpretation Act 1954 (Qld). The absence of an express time frame in s 21(5) does not permit a claimant to delay service indefinitely. Failure to serve as soon as possible deprives the adjudicator of jurisdiction. In circumstances where the respondent is legally represented and has given instructions to accept service, same-day service may be required, and a delay of 12 business days will not satisfy the requirement.
