The parity principle does not require identical sentences for co-offenders where significant disparities in personal circumstances and circumstances of offending explain the differences. A sentencing judge's failure to specifically mention every mitigating factor does not establish a failure to take it into account where the sentencing remarks as a whole indicate the factor was considered. For serious home invasion offences involving armed intruders threatening occupants in the presence of young children, a sentence of three years' imprisonment with parole after 12 months is within the appropriate range.
