Section 332 of the Crime and Corruption Act 2001 (Qld) requires an ongoing investigation at the time of both filing and hearing; it does not authorise review of a completed investigation or orders to reopen one. A police officer seconded to the CCC retains full police powers including the power to charge, and the CCC cannot direct such an officer as to the exercise of those powers. Procedural fairness in the context of closed coercive CCC hearings does not extend to allowing a suspect to cross-examine witnesses examined in separate closed sessions. Challenges to the use of coercively obtained evidence are properly ventilated in the criminal proceedings, not in collateral proceedings against the CCC.
