Consent to sexual intercourse given in the immediate aftermath of sustained violence and threats to kill may be found by a jury not to be free and voluntary consent, notwithstanding the complainant's evidence that she consented. A trial judge's failure to repeat the standard of proof in a final redirection on mistake of fact does not constitute misdirection where the aide memoire provided to the jury specifically identifies the requisite standard.
