Where the Crown advances alternative bases of criminal responsibility under s 7 of the Criminal Code (Qld), the trial judge must direct the jury to separately consider each alternative, identify the evidence admissible on each, and explain how the evidence relates to establishing criminal responsibility under s 7. Directing the jury that 'common unlawful purpose' or 'joint criminal enterprise' provides a means of attaching criminal responsibility is erroneous unless the direction, taken as a whole, confines the jury to the bases of liability in s 7. The proviso will not save a conviction where fundamental irregularities pervade the particulars, evidence, and directions, and the Crown has not demonstrated by careful examination of the admissible evidence that guilt was proved beyond reasonable doubt on each alternative.
