A fresh psychologist's report that expresses opinions no different from (or more guarded than) a report already tendered at sentencing does not constitute 'new evidence' warranting reception on a sentence appeal. A sentence requiring actual imprisonment for possession of over 34 kilograms of cannabis as a paid courier is within the proper exercise of the sentencing discretion notwithstanding the offender's youth and lack of criminal history.
