The parity principle requires comparison with the sentence actually imposed on a co-offender, not a notional sentence mentioned in the co-offender's sentencing remarks. A serious violent offence declaration under s 161B(3) of the Penalties and Sentences Act 1992 (Qld) must be exercised as part of the integrated sentencing process, and failure to adjust the head sentence to account for the effect of the declaration constitutes sentencing error. Manslaughter arising under s 8 Criminal Code party liability, rather than as a principal offender, is not ordinarily outside the norm so as to warrant an SVO declaration.
