The definition of 'construction company' in s 56AC(7) of the QBCC Act extends to companies carrying out building work in any Australian State, not only Queensland. A director of an interstate construction company that enters liquidation may be an 'excluded individual' whose Queensland builder's licence is subject to cancellation. Section 56AC is constitutionally valid as Part 3A regulates Queensland licensing, not interstate conduct, and the extraterritorial connection is sufficient under the liberal test in Union Steamship v King.
