The CDJ v VAJ criteria for admission of fresh evidence on statutory appeal apply to civil Magistrates Court appeals under s 40 of the Magistrates Court Act 1991 (SA) and r 286(3)(a) of the Supreme Court Civil Rules 2006 (SA). Parties are confined to the quantum pleaded in their counterclaim unless the opposing party acquiesces in the case being conducted outside the pleadings; adducing evidence of higher amounts without amending the pleading does not suffice. The public interest in finality of litigation is a significant factor weighing against admission of fresh evidence in civil disputes of limited dollar value concerning events that occurred many years earlier.
