The Full Court has no power to award costs on a question of law reserved under Division 2 Part 11 of the Criminal Law Consolidation Act 1935 (SA), except under s 351B(1) (which applies only where the Crown reserves a question following an acquittal). The power to make 'consequential orders and directions' under s 351A(1) does not extend to costs orders. Parties who succeed on reserved questions of law in criminal proceedings must bear their own costs.
