The determination of whether two persons were living together in a close personal relationship under s 11B(2)(b)(i) of the Family Relationships Act 1975 (SA) is an evaluative assessment of objective facts that is essentially impressionistic, and an appellate court will not interfere with the primary decision-maker's evaluative judgment unless the findings are demonstrated to be wrong by incontrovertible facts or uncontested testimony, or are glaringly improbable or contrary to compelling inferences. Objective indicia such as notification of address changes to authorities, financial institutions and Centrelink, the provision of keys, and the deceased's own characterisation of the relationship to third parties are significant factors in the assessment.
