The term 'employment' in s 113(2) of the Workers Rehabilitation and Compensation Act 1986 (SA) means employment with respect to which the WRC Act confers a workers' compensation entitlement for hearing loss. Where a worker's employer becomes licensed under the Safety, Rehabilitation and Compensation Act 1988 (Cth), the worker retains an entitlement under the WRC Act for noise-induced hearing loss sustained during the period when the WRC Act applied, and s 108A of the SRC Act preserves that entitlement. The deeming provision in s 113(2) does not operate to deny compensation by deeming the injury to have occurred during a period when the employer was licensed under the SRC Act.
