Where a stay pending appeal has been granted on conditions including payment of arrears, breach of those conditions may result in the stay being varied or lifted, even where the breach has not yet caused actual prejudice to the assets in question. An order requiring payment of arrears is to be construed as imposing a specific payment obligation, not merely as applying in circumstances where the relevant asset is in jeopardy. Informal departmental assurances not to take enforcement action do not provide a reliable basis for non-compliance with court orders.
