Even very substantial mitigating circumstances — including youth, profound disadvantage, Aboriginal heritage, PTSD causally connected to offending, and meaningful Koori Court participation — cannot reduce sentences for serious armed robbery involving firearms, pursuit, and gratuitous violence to a level that fails to adequately serve general deterrence, specific deterrence, and denunciation. The Fernando principles regarding substance abuse reflecting socio-economic circumstances may be applied with appropriate adaptation to Aboriginal offenders whose upbringing, though not within an Aboriginal community, shared features of disadvantage and dysfunction.
