In a multi-count, two-complainant sexual offence trial where the prosecution disavows tendency reasoning, a separate consideration direction that merely instructs the jury to consider each charge separately 'in light only of the evidence which applies to it' is insufficient — the trial judge must go on to identify for the jury which evidence is and is not admissible in relation to each count. Failure to do so creates a nigh on irresistible risk of impermissible tendency reasoning and will constitute a substantial miscarriage of justice.
