A trial judge's adverse findings about an applicant's conduct towards the deceased in testator's family maintenance proceedings will not vitiate the exercise of discretion where the judge focused on objective financial considerations (estate value, applicant's needs, competing claims) rather than attributing significant weight to the moral obligation factor when determining quantum. Beneficiaries of a will are not required to demonstrate need or establish a moral obligation to be entitled to the provision left to them by the deceased.
