The Court found Mr Rao to be a serious danger to the community under s 7 of the Dangerous Sexual Offenders Act 2006 (WA) and ordered his indefinite continuing detention under s 17(1)(a), on the basis that his history of serious sexual offending against vulnerable adolescent females, lack of insight, regression from treatment gains, and the psychiatric evidence established to a high degree of probability an unacceptable risk of reoffending. The Court was not satisfied that a supervision order could adequately protect the community, as the risk had not been reduced from the level at which Mr Rao had previously reoffended.
