Where an offender is convicted of both aggravated robbery and taking a motor vehicle without consent in respect of the same vehicle, the sentences should be wholly concurrent because the motor vehicle element adds nothing to the objective gravity of the overall conduct. A modest sentencing reduction (here, three months) may be appropriate to reflect the impact of COVID-19 on custodial conditions, particularly for Aboriginal prisoners over 50 with chronic health conditions. The parity principle operates only in favour of offenders, not the Crown.
