Systematic negligence — a failure over time to investigate or disclose a health condition affecting capacity to drive — is not necessarily less serious than negligence closely temporally associated with the accident causing death. Professional truck drivers bear a heavy duty to investigate and disclose suspected health conditions given the danger posed by heavy vehicles, and general deterrence is given heightened weight for this class of offender due to commercial pressures creating incentives to conceal health issues. The absence of actual knowledge of a diagnosis does not preclude a finding of mid-range objective seriousness where the offender was repeatedly on notice of a possible condition.
