Where a delegate has made positive findings on duress in a protection visa assessment and the Department's communications indicate those findings are treated as settled, the Minister is required to afford procedural fairness by notifying the applicant before making contrary factual findings on duress in a subsequent s 501(1) character refusal decision, and must engage in an active intellectual process with clearly articulated submissions on that central issue.
