Practitioners advising on informal lending arrangements should note that where a spouse authorises borrowing, the scope of implied authority is limited by ordinary business practice and does not extend to agreeing to exorbitant interest rates; and that the equitable principle of recoupment under Bannatyne v MacIver provides only for recovery of the principal sum applied to discharge the principal's debts, not interest at the rate agreed by the unauthorised agent.
