The Court held that s 6DD of the Royal Commissions Act 1902 (Cth) does not prevent the use of Royal Commission transcript and video evidence in defamation proceedings where it is tendered in aid of a fair report defence rather than to establish the civil or criminal liability of the person who gave the evidence.
