A starting point of 12 years imprisonment for a single-victim motor vehicle manslaughter, even involving extreme intoxication and prolonged dangerous driving, was manifestly excessive having regard to comparable NSWCCA decisions. The appropriate starting point was 10 years. The Bugmy principles relating to childhood deprivation do not override the assessment of objective seriousness where moral culpability remains high notwithstanding the offender's deprived background.
