An applicant for leave to appeal against sentence cannot contend on appeal that the sentencing judge's assessment of objective seriousness was erroneous where that assessment accorded with the submissions made by the applicant's own counsel at the sentence hearing. An appeal is not an opportunity to reformulate or depart from submissions put below.
