Where an accused's trial counsel withdraws during a criminal trial through no fault of the accused, the trial judge must treat the accused as unrepresented and apply the Dietrich principle by asking whether the trial is likely to be unfair if the accused is forced on unrepresented. The reasons for counsel's withdrawal are not relevant to this inquiry. Case management considerations and the desire to keep a trial on foot cannot override the accused's right to competent representation.
