When sentencing for an indictable offence dealt with summarily in NSW, the correct approach is to assess the appropriate sentence within the context of the prescribed maximum penalty for the offence (not the jurisdictional limit), apply any discount for a guilty plea, and then reduce the sentence to the jurisdictional limit if it would otherwise be exceeded. The 'starting point' before discount may exceed the jurisdictional limit. This applies equally in the Local Court and when the District Court or Supreme Court deals with 'related offences' under ss 166-168 of the Criminal Procedure Act 1986.
