Repeat criminal contempt involving republication of material previously found contemptuous is an especially serious aggravating factor warranting a longer good behaviour bond than that imposed for the original offence. Indemnity costs are appropriate in contempt proceedings where the conduct is a repeat offence and the contemnor knew the publications were unlawful. A contemnor's inability to pay costs does not preclude a costs order, though capacity to pay is relevant to the quantum of a fine under s 6 of the Fines Act 1996 (NSW).
