A party who succeeds on appeal on an argument not raised at the hearing below, and who consented to the procedure that produced the hearing below, may not recover costs of that hearing even though they succeeded on appeal. Where a separate question is found on appeal to have been inappropriate, and both parties promoted its determination, costs of the hearing below may be left to lie where they fall rather than following the event of the appeal.
